Eviction Moratorium Extension

EXTENSION THROUGH JANUARY 15, 2022

Mayor Durkan has officially announced the January 15, 2022 extension of Eviction Moratorium for residential and commercial evictions and continuation of additional COVID-related protections.

Through Executive Order 2021-07: COVID- 19 (Civil Emergency- Extensions of City Closures and Relief Measure) city departments are directed to further extend their actions to combat the spread of the COVID-19 pandemic and to mitigate the impact of the public health emergency on the people of Seattle.

This marks the sixth extension of the eviction moratorium as part of the COVID-19 civil emergency since March 14, 2020, when Seattle declared one of the first eviction moratoriums in the country.

Unless, there is an "imminent threat" to the health and safety of the community the executive order continues tenant protections, prohibiting landlords from issuing notices of termination or otherwise initiating eviction actions with the courts.

Tenants are still legally required to pay rent during the moratorium. Rent is not canceled. If a tenant is unable to pay the full rental amount then they should be making partial payments. Tenants will still owe rent for the unpaid months, but cannot be evicted before the end of the moratorium on January 15, 2022.

For tenants that are not able to meet their rental obligations, Phillips has been working on behalf of our clients to establish mutually agreed upon payment plan protection.

Ordinance 126075 will provide tenants with a six-month period after the moratorium expires in which they can claim a defense against eviction for non-payment of rent. Renters will be required to demonstrate financial hardship due to the pandemic.

The ordinance will protect renters from evictions through mid-June 2022, according to the mayor's office.

Phillips is working with "Seattle For Growth" advocating for Landlord’s during the moratorium.
